Terms of Use

1. Who we are

ne0nTV (the "App") is provided by NE0N STUDIO (ne0n.studio), a brand of BURNT CHROME, NIP 5451750958, ul. Księże Domki 2B/11, 96-200 Rawa Mazowiecka, Poland ("we", "us"). You can reach us at support@ne0n.tv.

These Terms of Use (the "Terms") are an agreement between you and us about your use of the App and the services it uses (together, the "Service"). By downloading or using the App you accept these Terms. If you don't accept them, don't use the App.

2. What the App does

The App shows sports information for the teams and players you follow: schedules, live scores, results, standings and a curated list of important events. On the ALL-PRO plan, it can also look through an IPTV playlist and programme guide that you add, to suggest which of your channels shows a game, and play that channel.

We may change, add or remove features to improve the App, keep it working with its data sources, or meet legal requirements. If a change substantially reduces what a paid plan includes, we will tell you in the App or on this page before it takes effect.

3. IPTV services are yours, not ours

• We do not provide, sell, host, recommend or distribute any TV channels, streams, playlists or programme guides. The App includes none.
• Any playlist you add comes from a provider you chose and contract with yourself. The App only connects to the addresses you enter.
• You are solely responsible for making sure you have the right to access and watch the content your provider supplies, in the country where you watch it. Do not use the App with services that infringe copyright or other rights.
• We are not responsible for the availability, quality, legality or content of any third-party service, or for your agreement with your provider.

4. Plans and subscriptions

ROOKIE is free. SENIOR and ALL-PRO are auto-renewable subscriptions sold through Apple's App Store, each with a monthly or a yearly billing period. The App shows what each plan includes and its current price before you buy.

• Payment. Payment is charged to your Apple ID at confirmation of purchase. Apple processes all payments; we never see your payment details.
• Automatic renewal. A subscription renews automatically for the same period, at the then-current price, unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
• Cancelling. You can manage or cancel a subscription at any time in your Apple TV's Settings > Users and Accounts > Subscriptions, or in your Apple ID's settings on another Apple device. Cancelling stops the next renewal; the plan stays active until the end of the period you paid for (shown in the App as VALID UNTIL). After that, the App returns to ROOKIE.
• Changing plans. Moving up from SENIOR to ALL-PRO starts at once, and Apple refunds the unused part of the previous subscription in proportion. Moving down from ALL-PRO to SENIOR, or changing the billing period, takes effect at the next renewal.
• Refunds. Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com. This does not limit any rights you have under the law of your country.
• Price changes. If we change a subscription's price, Apple notifies you in advance as its rules require, and where the law or Apple requires it, asks for your consent before you are charged the new price.
• Moving to ROOKIE. When a paid plan ends, features it included stop working. Favorite teams over ROOKIE's limit are set aside, not deleted, and come back if you subscribe again.
• Restoring. A subscription belongs to your Apple ID. Use Restore Purchases in the App to use it on another Apple TV signed in with the same Apple ID.

Your right of withdrawal (EU and UK consumers). Digital content and services bought through the App Store are subject to Apple's terms on withdrawal. When you buy a subscription, you ask for it to start immediately; under EU and UK law the 14-day right of withdrawal may then no longer apply once access has begun. Apple's terms on this, and any refund it grants, take precedence.

5. Information in the App

Sports data, images, TV listings and channel suggestions come from third-party sources (such as TheSportsDB and data published by leagues and broadcasters), from your IPTV provider, and from other viewers' answers about which channel shows a game. We work to keep it accurate, but we cannot guarantee that scores, times, standings, listings or suggestions are complete, current or correct. Don't rely on the App for betting or any decision where an error would cost you.

Team, league and broadcaster names, logos and marks belong to their owners and are used only to identify them. ne0nTV is not affiliated with, endorsed or sponsored by any league, team, broadcaster or data provider.

6. Your answers about channels

When you answer the App's questions about a stream (for example YES, DIFFERENT GAME or NOT A SPORTS EVENT), the answer is sent to our server without your name or any account, and is combined with other viewers' answers to suggest channels to everyone. You give us a free, worldwide, perpetual licence to use, store and publish these answers in combined form to run and improve the Service. Please answer honestly; deliberately misleading answers may be ignored.

7. Fair use

You may use the App for your own personal, non-commercial use. You agree not to:

• copy, modify, distribute, sell or rent the App, or reverse engineer it, except where the law allows this despite this restriction;
• access our server other than through the App, overload it, scrape it, or get around its security or rate limits;
• use the App to break any law or anyone's rights, including intellectual property rights;
• submit automated or false answers.

We may suspend the Service for a device that breaks these rules or endangers the Service.

8. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. The App and its content (apart from third-party material) belong to us and our licensors; everything not expressly granted is reserved.

9. Availability

The App depends on the internet, on our server and on third-party services. We aim to keep it running, but it may sometimes be unavailable or limited, for example during maintenance or when a data source changes or stops. We may discontinue the App; if we do, we will stop renewals in advance where we can, and paid periods already running will be handled under Apple's refund rules and the law.

10. Warranty and liability

Nothing in these Terms limits rights you have as a consumer under mandatory law, including statutory rights when digital content or a service doesn't conform to the contract.

Within that limit, the App is provided "as is" and "as available". We do not guarantee that it will be error-free or uninterrupted, or that the information in it is correct.

We are fully liable for damage we cause intentionally or through gross negligence, and for injury to life, body or health. In other cases, and as far as the law allows, we are not liable for indirect or consequential loss, lost profits or lost data, and our total liability is limited to the amount you paid for the App in the 12 months before the event that caused the damage.

11. Apple

These Terms are between you and us, not Apple. In addition:

• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the App or your possession and use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

Where these Terms conflict with Apple's Licensed Application End User License Agreement on any point above, these Terms apply; otherwise that agreement also applies to your use of the App.

12. Changes to these Terms

We may update these Terms, for example when features, the law or Apple's rules change. We will publish the new version on this page with its effective date. For significant changes affecting paid plans, we will also tell you in the App before they take effect. If you don't agree with the new Terms, you can cancel your subscription and stop using the App.

13. Law and disputes

These Terms are governed by the law of Poland. If you are a consumer living in another country, you keep the protection of the mandatory rules of the law of your country, and you may bring proceedings in the courts there. Before going to court, please contact us at support@ne0n.tv; most problems can be solved quickly.

If any part of these Terms is found invalid, the rest remains in force.
